FERIADOS NACIONALES

Modificación. Decreto N° 1584/2010.

VISTO el Decreto N° 1584 del 2 de noviembre de 2010 y el Decreto N° 52 del 20 de enero de 2017, y
CONSIDERANDO:
Que mediante el Decreto N° 52/17 se modificó el régimen de los feriados nacionales y de los días no laborables regulado por el Decreto N° 1584/10.
Que resultó necesario reformular el anterior régimen general de los feriados nacionales, en tanto el mismo impactaba negativamente en la actividad productiva y en la cantidad de días de clase imprescindibles para el año lectivo.
Que la norma mencionada tuvo por finalidad encontrar un balance en el diseño de diferentes políticas públicas, tanto las orientadas al desarrollo del turismo como las de fomento de la actividad productiva y la mejora de la calidad educativa.
Que, en consecuencia, se dispuso la eliminación de los feriados con fines turísticos y la movilidad de la mayoría de los feriados nacionales a fin de que se cumplan en días lunes, relacionándose este último extremo con el hecho de que los comercios en general desarrollan su actividad los días sábados también, y la movilidad del feriado permite el equilibrio entre la actividad comercial y el turismo.
Que el referido Decreto N° 52/17 desde ningún punto de vista ha buscado desconocer el valor simbólico e histórico de los feriados nacionales. Por el contrario, fue dictado en la inteligencia de que un buen ejercicio de memoria es el trabajo pedagógico en las escuelas mediante el cual se conmemore con recursos educativos estos hitos históricos.
Que, teniendo en consideración lo expresado precedentemente, resulta procedente sustituir el artículo 4° del ya citado Decreto N° 1584/10, modificado por su similar N° 52/17, incorporando al listado de los feriados exceptuados de ser trasladados los correspondientes a los días 24 de marzo, 2 de abril y 20 de junio.
Que ha tomado la intervención de su competencia la DIRECCIÓN GENERAL DE ASUNTOS JURÍDICOS dependiente de la SUBSECRETARÍA DE COORDINACIÓN del MINISTERIO DEL INTERIOR, OBRAS PÚBLICAS Y VIVIENDA.
Que la presente medida se dicta en uso de las atribuciones conferidas por el artículo 99, inciso 3 de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
EN ACUERDO GENERAL DE MINISTROS
DECRETA:
ARTÍCULO 1° — Sustitúyese el artículo 4° del Decreto N° 1584/10, modificado por el Decreto N° 52/17, el que quedará redactado de la siguiente manera:
“ARTÍCULO 4°.- Se exceptúan de la disposición del artículo 2°, los feriados nacionales correspondientes al 1° de Enero, Lunes y Martes de Carnaval, 24 de Marzo, 2 de Abril, Viernes Santo, 1° de Mayo, 25 de Mayo, 20 de Junio, 9 de Julio, 8 de Diciembre y 25 de Diciembre.”
ARTÍCULO 2° — La presente medida entrará en vigencia al día siguiente al de su publicación en el Boletín Oficial.
ARTÍCULO 3° — Dése cuenta a la COMISIÓN BICAMERAL PERMANENTE del HONORABLE CONGRESO DE LA NACIÓN.
